HJR379 - Application for Convention of States
OVERVIEW: House Joint Resolution 379 would request that Congress call an Article V Convention
for proposing amendments to the United States Constitution.
CURRENT LAW: Article V of the United States Constitution provides that proposals to amend the
federal Constitution can be made in either of the following ways:
• Two-thirds of Congress can propose amendments, or
• Two-thirds of state legislatures (34 states) can request that Congress call a convention for
proposing amendments. (Article V Convention).
BILL ANALYSIS: House Joint Resolution 379 would request that Congress call an Article V convention
for proposing amendments to the United States Constitution limited to the following topics:
• Imposing fiscal restraints on the federal government.
• Limiting the power and jurisdiction of the federal government.
• Limiting the terms of office for federal government officials and for members of Congress.
The application for a convention would continue until the legislatures of at least two-thirds of the states
have also made applications on the same subject. The North Carolina Secretary of State would be required
to transmit the application to the relevant parties.
EFFECTIVE DATE: House Joint Resolution 379 would become effective on ratification.
